TERMS OF USE FOR CUSTOMERS / USERS

These Terms of Use (“Terms”) govern your access to and use of the website (“Site”) and the mobile application operated under the brand GINTAA (“Gintaa App”), collectively referred to as the “Platform”, through which food ordering and related services (“Services”) are made available.
By accessing or using the Platform, you agree to be bound by these Terms and enter into a legally binding contract with Ascon Softech Private Limited, the owner and operator of GINTAA, and its affiliates (collectively, “Gintaa”, “we”, “us”, or “our”).
If you do not agree to these Terms, you must discontinue use of the Platform immediately.
DEFINITIONS
- Customer / You / Your: Any individual who accesses or uses the Services.
- Platform: The Gintaa website and mobile application.
- Restaurant Partner: Restaurants, cloud kitchens, hotels, or food establishments listed on the Platform.
- Content: Reviews, ratings, images, videos, text, data, and other information displayed on or through the Platform.
- Gintaa Content: Content owned or licensed by Gintaa, excluding Customer Content and Third-Party Content.
- Customer Content: Content uploaded or shared by Customers.
- Third-Party Content: Content originating from Restaurant Partners or other third parties.
REPRESENTATIONS & WARRANTIES
You represent and warrant that:
- You are at least 18 years of age and legally competent to contract.
- You will use the Platform strictly in accordance with applicable laws of India.
- Information displayed on the Platform is provided on an “as available” basis, and Gintaa does not guarantee accuracy, completeness, or timeliness of such information.
- Gintaa does not guarantee food quality, pricing, availability, or certifications, which are the sole responsibility of the Restaurant Partner.
- Any reliance on Platform information is at your own risk.
USE OF SERVICES
- You must create an account using accurate and current information.
- You agree to receive transactional and service-related communications from Gintaa.
- You shall not misuse the Platform, attempt unauthorised access, scrape data, or use the Services for unlawful or commercial purposes without written consent.
TELEPHONY & CALL RECORDING
Where telephony services are provided to connect Customers with Restaurant Partners:
- Calls may be recorded for lawful purposes including customer support, billing verification, quality control, and dispute resolution.
- By using such services, you expressly consent to such recording and storage in accordance with applicable law.
PRIVACY & DATA PROTECTION
Your personal data is processed in accordance with Gintaa’s Privacy Policy, the Digital Personal Data Protection Act, 2023, and applicable rules.
Gintaa may disclose information where required to:
- comply with legal obligations,
- prevent fraud or unlawful activity, or
- protect rights, safety, and property.
FOOD ORDERING & DELIVERY
- Gintaa facilitates food ordering by enabling Customers to place orders with Restaurant Partners on a principal-to-principal basis.
- Food preparation, quality, quantity, packaging, and statutory compliance remain the sole responsibility of the Restaurant Partner.
- Delivery of orders may be undertaken by Restaurant Partners and/or third-party delivery partners engaged independently.
- Gintaa acts as a technology intermediary and does not manufacture or sell food.
While Gintaa endeavours to ensure a smooth ordering and delivery experience, it shall not be liable for deficiencies attributable to the Restaurant Partner or delivery personnel, except as required under applicable consumer protection laws.
DELIVERY CHARGES & PAYMENTS
- Delivery charges may be levied as determined by the Restaurant Partner or delivery service provider.
- Gintaa may collect such charges on behalf of the Restaurant Partner.
- Applicable taxes shall be charged as per law.
DIGNITY & NON-DISCRIMINATION
- Customers shall treat delivery partners and restaurant staff with dignity and fairness and shall not discriminate on grounds of religion, caste, gender, disability, or any other protected characteristic.
- Harassment or abusive behaviour towards delivery partners may result in suspension or termination of access to the Platform.
DISCOUNTS, COINS & PROMOTIONS
- Promotional offers, coins, vouchers, or cashback are subject to specific terms and availability.
- Gintaa reserves the right to modify, suspend, or discontinue promotions at its discretion.
CANCELLATION & REFUNDS
Orders, once confirmed, may not be cancellable except as provided under Gintaa’s applicable cancellation and refund policy or where required under applicable consumer protection laws.
Refunds, if any, shall be processed strictly in accordance with such policy.
RESTRICTIONS ON USE
You shall not upload or transmit content that is illegal, defamatory, misleading, abusive, infringing, deceptive, or otherwise objectionable, or that violates any law or third-party rights.
FEEDBACK
Any feedback submitted by you may be used by Gintaa without restriction, obligation, or compensation, and you waive all related claims.
INDEMNITY
To the extent permitted by applicable law, you agree to indemnify and hold harmless Gintaa from claims arising out of your misuse of the Platform, violation of these Terms, or infringement of third-party rights.
TERMINATION
- You may delete your account at any time.
- Gintaa may suspend or terminate access for violation of these Terms or unlawful conduct.
- Re-registration after termination may be restricted.
LIMITATION OF LIABILITY
Gintaa shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform, except to the extent expressly required under applicable law.
NO PARTNERSHIP OR AGENCY
Nothing in these Terms creates any partnership, agency, or employment relationship between you and Gintaa.
GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India. Courts at Kolkata, West Bengal shall have exclusive jurisdiction. In case of inconsistency between these Terms and applicable law, the provisions of such law shall prevail.
UPDATES
Gintaa may update these Terms from time to time. Continued use of the Platform constitutes acceptance of revised Terms.
